TERMS AND CONDITIONS

Welcome to the Central Bank of Ireland website (the “Website”) terms and conditions of use (the “Terms”). These Terms apply to your use or access of this Website and set out of conditions upon which the Central Bank of Ireland (“Central Bank”, “us”, “we”, “our”) agree to sell commemorative coins and coin sets (“Coins”) to you.
These Terms also apply to the purchase of Coins from us using any method of sale.

By using the Website, you agree to be bound by the Terms. If you do not agree to be bound by the Terms, then you should not use the Website or purchase the Coins. The following definitions are used throughout the Terms, and you should familiarise yourself with them:
“Customer” means a natural person who purchases Coins for purposes which are outside the person’s trade, business, craft or profession.
“Contract” means the contract between us and you for the sale and purchase of the Coins in accordance with the Terms. 
“Force Majeure Event” means an event or circumstance beyond our reasonable control.

Order Process
You may place an order for the Coins via the Website.

Website orders: When you make an order via the Website, you will receive an email from us acknowledging that we have received your order (the “Order Confirmation”). This does not mean that your order has been accepted. Your order constitutes an offer to us to buy Coins. All orders are subject to acceptance by us.

We reserve the right to refuse to sell Coins that you have ordered without giving any reason and without any liability to you. If we are unable to accept your order for any reason, we will inform you of this and we will not charge you for the Coins. Otherwise you should expect to receive your order in line with the Delivery conditions noted below.

We are under no obligation to fulfil any order until we have received payment.

The Contract does not entitle the Customer to any follow-up orders.
 
The Coins

The images of the Coins on the Website are for illustrative purposes only. Although we have made every effort to display the colours of the Coins accurately, we cannot guarantee that they are displayed accurately on your screen. Accordingly, Coins, when delivered to you, may vary slightly from how they appear on the Website. We take no responsibility for any such variation.  

The packaging of the Coins may vary from that shown on the Website.

Price
The prices of the Coins as advertised on the Website are subject to change from time to time.

While we take all reasonable care to ensure that the price of the Coins as advertised is correct, it is possible that, despite our best efforts, some Coins may be advertised at an incorrect price and/or the delivery charges advertised may be incorrect. Where the Coins' correct price/delivery charges at your order date is less than our stated price/delivery charges at your order date, we will charge the lower amount. If the Coins' correct price/delivery charges at your order date is higher than the stated price/delivery charges at your order date, we will contact you to confirm whether you want to proceed with the order.

For orders made via the Website, the total price of the Coins (which includes VAT and delivery charges) will be displayed at checkout before you place your order.  You can pay for Coins ordered via the Website by credit or debit card and monies will be debited immediately, at which point the Contract is effective..

Availability And Delivery

The availability of the Coins as advertised on the Website is subject to change from time to time.

Delivery methods will be indicated on the Website at the start of the checkout  process.  Customers are referred to the delivery conditions at https://www.collectorcoins.ie/en/delivery/.

We will endeavour to deliver the Coins within 30 days after the date on which the Contract is concluded. If delivery is delayed for more than 30 days, you have the right to contact us to request that the Coins be delivered within an additional period of time. If the Coins are not delivered within that additional period, you have the right to terminate the Contract and refuse to accept the Coins. If you decide that you do not want to accept the Coins, we will refund any money paid by you, including delivery costs, without undue delay. However, we will not be responsible for any other losses, costs, damages or charges that you may suffer if we delay in delivering or do not deliver the Coins to you. If you fail to return the Coins to us within a reasonable time, you will be deemed to have accepted the Coins and you will be charged for your order at the price set out on the Website at that time. This does not affect your statutory rights.

Complaints
If you have a complaint, please contact us directly and we will do our best to resolve your complaint. If you are not satisfied with our response, you may contact the Competition and Consumer Protection Commission, whose contact details are here: http://ccpc.ie/.You have the right to seek to resolve any disputes through an online dispute resolution (ODR) platform operated by the European Commission. Liability And Disclaimers
All coins sold and product descriptions, information and materials posted on this Website are provided “as is” and without warranties express, implied or otherwise.

We warrant to you that Coins purchased from us are of satisfactory quality and reasonably fit for all of the purposes for which they are commonly supplied. To the fullest extent permissible by law, we disclaim all other warranties of any kind, whether express or implied, in relation to the Coins.

Our liability in connection with any Coins purchased from us is strictly limited to the purchase price of that Coin or Coins. This does not affect your statutory rights or your cancellation rights.

Intellectual Property Rights

Reproduction is authorised provided the source is acknowledged and prior written permission has been obtained from the Central Bank of Ireland and the owner/provider of information. Users should contact the Central Bank of Ireland for details of the appropriate licence required to permit the use of notices published on the Website.

(p.b)Users are prohibited from using (including reproduction or scraping information for onward transmission to third parties) information on the Website for commercial purposes.

We do not accept responsibility for and shall not be liable, either in contract or in tort, for any direct, incidental, consequential, indirect loss or any other losses, costs, expenses or damage of any kind caused as a result of using the Website in any respect including:

  • non-availability of the Website;  

  • accuracy, suitability, and completeness or otherwise of the information and data contained on the Website;  

  • any errors in transmission or downloading documentation from the Website;

  • breach of the Terms of Use by a Customer;

  • loss of data or information;

  • non-functioning or malfunctioning of the Website or technical issues otherwise occurring in connection therewith.

We have taken all reasonable care to compile information and material on this Website.

This website is established in Ireland in accordance with the laws of Ireland and will be governed by the laws of that country. When you use the website, you accept that your use of the website and any information on the website will also be governed by the laws of Ireland and if any claim or dispute arises from your use of the website or any information on it, you agree that the Irish Courts will have exclusive jurisdiction over all such claims or disputes.

Cooling Off Period: Your Right To Cancel
For orders made via the Website, you have a statutory right under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013 to cancel the contract and return the Coins to us within 14 days of receipt without giving a reason.

The cancellation period will expire after 14 days from the day on which you acquire physical possession of the Coins.

To exercise your right to cancel, you must contact us using one of the means above and provide us with an unequivocal statement of your intention to cancel the Contract.

If you decide to cancel the Contract, we will refund payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to cancel this Contract. However, we reserve the right to withhold the refund until we have received the Coins back but no monies will be refunded for Coins which are returned in a damaged condition.

We will refund you using the same means of payment as you used for the initial transaction, you will not incur any fees when being refunded, however you will bear the direct cost of returning the Coins to us.

Risk And Title
Coins ordered by you will be at your risk from the time of delivery. Ownership of the Coins will only pass to you when we receive full payment of all sums due in respect of your order, including delivery charges.

General Refund And Returns Policy
You have the right to a refund or replacement if the Coins (i) do not match, in all material terms, their description or (ii) are not of merchantable quality, unless the defects were specifically drawn to your attention before the Contract was made, or you examined the Coins before the Contract was made.

You do not have a right to a refund or replacement if (i) you have broken or damaged the Coins or (ii) you have changed your mind after receipt of the Coins and it is more than 14 days since you received the Coins.

If the capsule or blister containing the Coin has been opened, the Coin cannot be returned to us and money will not be refunded.

If you have a right a refund or replacement, we will (i) refund to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay or (ii) arrange for a replacement to be sent to you. Please contact us to request a refund or a replacement.

General
We have the right to revise and amend these Terms from time to time by posting revised Terms on the Website.

We shall not be liable for any failure to perform any of our obligations under these Terms which is caused by circumstances beyond our reasonable control including, but not limited to, any Force Majeure Event.

Our failure to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.

By agreeing to these Terms you shall be deemed also to have read, understood and agreed to the following policies which also apply to your use of the Website:
(i) Privacy Policy and (ii) Cookie Statement.

These Terms and any matter connected with any order placed through the Website shall be construed in accordance with the laws of Ireland and you agree to submit to the exclusive jurisdiction of the Irish Courts in respect of same.
